These Terms & Conditions (“Terms”) govern your use of Nuudge, operated by Brash Technology LLC (“Nuudge,” “we,” “us”). By opting in or using the service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use Nuudge.

What Nuudge is — and isn’t

Nuudge is a supportive, conversational wellness companion delivered by text message, for general habit support and encouragement. Nuudge is not a medical, healthcare, mental-health, or professional service. It does not provide medical advice, diagnosis, treatment, or prescriptions, and using it does not create a doctor, therapist, dietitian, or other professional relationship. For any medical or mental-health concern, consult a qualified professional. If you may be in crisis, call or text 988 (U.S. Suicide & Crisis Lifeline) or your local emergency number.

Eligibility

You must be at least 18 years old and able to form a binding contract. You confirm that the mobile number you provide is yours and that you consent to receive text messages at it.

Text message program

With your consent, Nuudge sends recurring wellness messages; frequency varies (typically a few per week).
Message and data rates may apply, depending on your mobile plan.
Reply STOP to unsubscribe at any time, or HELP for help.
Mobile carriers are not liable for delayed or undelivered messages.

Not medical advice; assumption of risk

All content is general and informational. You are solely responsible for your own health and lifestyle decisions and should consult qualified professionals before making changes. You use Nuudge at your own risk, and it should never be relied on for emergencies.

Acceptable use

Don’t use Nuudge for any unlawful purpose, don’t attempt to disrupt or misuse the service, and don’t submit other people’s personal information without their permission.

Your content

You keep ownership of the messages you send. You grant us a limited license to use your messages to operate, personalize, and improve the service as described in the Privacy Policy.

Intellectual property

The Nuudge service, name, and content are owned by us or our licensors. We grant you a limited, revocable, non-transferable license to use the service as intended.

Disclaimers

The service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free, and we make no guarantee of any particular health, wellness, or weight outcome.

Limitation of liability

To the fullest extent permitted by law, Nuudge and Brash Technology LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

Indemnification

You agree to indemnify and hold harmless Brash Technology LLC from claims arising out of your misuse of the service or violation of these Terms.

Changes

We may modify the service or these Terms at any time. Material changes will be posted here; continued use after changes means you accept them.

Termination

You may stop using Nuudge at any time by replying STOP. We may suspend or terminate the service or your access at our discretion.

Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute.
